PERSONAL DATA PROTECTION, PROCESSING AND CONFIDENTIALITY POLICY

1.  INTRODUCTION

Protection of personal data is among the most important priorities of WinGIG Business IT Solutions. Hyderabad. (“Company” or “WinGIG”). Protection and processing of personal data of our customers, potential customers, employee candidates, company shareholders, company executives, visitors, and employees, shareholders and executives of the partner organizations, and of the third parties; which is managed by this Policy, constitutes the most important stage of this matter.

As per Indian law; everyone is entitled to request the protection of their personal data. With respect to the protection of personal data, which is an Constitutional right, WinGIG, exercises due care on protection and processing of personal data of its customers, potential customers, employee candidates, company shareholders, company executives, visitors, and employees, shareholders and executives of the partner organizations, and of the third parties; which is managed by this Policy and makes this a Company policy.

Within this scope, the necessary administrative and technical measures are taken by WinGIG and Foreign Shareholders in order to protect the processed personal data, pursuant to the relevant legislation.

This Policy shall provide detailed explanations on the basic principles, which WinGIG adopts on processing the personal data and which are listed below:

  • To process the personal data according to the law and in good faith,
  • To keep the personal data, correct and updated, when required,
  • To process the personal data for certain, explicit and legal purposes,
  • To process the personal data in connection with the processing purposes, limitedly and prudently,
  • To keep the personal data for a period stipulated in the relevant legislation or required for the processing purpose,
  • To notify and inform the owners of personal data,
  • To establish the required system in order to enable the owners of personal data to exercise their rights,
  • To take the required measures in respect to keeping the personal data,
  • To comply with the relevant legislation and regulations of the Personal Data Protection with respect to transferring them to the third parties in line with the requirements of processing purposes of personal data,
  • To be sensitive on processing and protection of private qualified personal data.

PURPOSE OF THE POLICY

The main purpose of this Policy is to explain the systems adopted by WinGIG for personal data processing activity and personal data protection performed in accordance with the law; within this scope, to ensure transparency by informing the persons, whose data is processed by our company, primarily our customers, potential customers, employees, employee candidates, company shareholders, company executives, visitors, and employees, shareholders and executives of the partner organizations, and of the third parties.

SCOPE

This Policy is related to all personal data of our customers, potential customers, employees, employee candidates, company shareholders, candidate job applicants, company executives, visitors, and employees, shareholders and executives of the partner organizations, and of the third parties, which are processed automatically or in un-automatic ways for being a part of any data recording system.

The scope of implementation of this Policy may be either the whole Policy (e.g. such as our Active Customers who are also our visitors) or only some provisions of it (e.g. only our visitors) with respect to the personal data owners’ groups in the abovementioned categories.

IMPLEMENTATION OF THE POLICY AND THE RELEVANT LEGISLATION

The relevant legal regulations in force on processing and protection of personal data shall have the priority in implementation. In case there are discrepancies between the legislation in force and the Policy, our Company acknowledges the implementation of the effective legislation.

The Policy is generated by embodying and arranging the rules, which are revealed by the relevant legislation, within the scope of WinGIG applications. Our Company carries out the required system and preparations in order to act in compliance with the enforcement periods stipulated in the Personal Data Protection Act.

2.  INFORMATION COLLECTION AND USE

WinGIG does not collect any personal information from a visitor to its site unless that visitor explicitly and intentionally provides it.

REGISTRATION AND ORDERING

In order to gain full benefits from WinGIG websites and applications users are required to register. During registration, users are required to give their contact information (such as name, email address, mailing address, and phone number). WinGIG may also collect demographic information (such as job title and responsibilities, organisation information and professional certification). For internal purposes, this information is used to communicate with users and provide requested services, and, for website visitors, to provide a more personal experience on WinGIG sites. WinGIG uses aggregate demographic information about its audience to improve its service, for marketing purposes and/or industry reporting purposes.

CONTACT AND RESUME INFORMATION

When you give WinGIG contact information (such as your name and email address) and demographic information, you agree that WinGIG may utilize this information as set forth herein. You agree that WinGIG may, as part of its services to you, communicate with you, or initiate communication with you on behalf of a 3rd party, through your WinGIG account or through other means made available through your contact information such as email, phone, or postal mail. If and to the extent permitted by applicable law, WinGIG, or its designated third-party partners, may also use your contact information to:

  1. send you job alerts;
  2. create an account;
  3. send you information about WinGIG; and,
  4. send you promotional material from some of WinGIG’s partners.

WinGIG may use demographic and/or profile data to tailor your experience on WinGIG’s site, show you content that WinGIG thinks you may be interested in, and display content according to your preferences. Your personal information gets placed on the WinGIG website when you upload or edit a resume. To the extent you upload a resume or edit it, and subject to your Privacy Settings, you are making the resume, your name and other personal information that you place on your resume available to third-parties who may be interested in you as an employee, search engines, or to the general public by posting your personal information on the internet. This may be crawled by, and displayed through, search engines when someone searches for your name. This means that third-parties can view the personal information contained in your resume and you may receive unsolicited contact from parties unaffiliated with WinGIG and for whom WinGIG has no responsibility. If you do not want your personal information posted on the Website, you should not upload it. You may opt-out of this feature by editing your Privacy Settings; however, WinGIG does not warrant how often third-party search engines will update their caches, which may contain old public resume information. WinGIG reserves the right to charge third parties a fee for accessing your information as part of WinGIG’s services. At your direction, WinGIG may also send your resume to third parties if you choose to apply for a job listing.

INFOCASTS

If users wish to subscribe to WinGIG, they are asked for email contact information. This information is used for the sole purpose of sending the information requested. This is an automated process. Recipients of WinGIG newsletters can unsubscribe using the instructions listed at the end of the email newsletter.

3.  COMMUNICATIONS WITH WinGIG

WinGIG has features that allow users to submit information such as help forms. Requests for service, support or information may be forwarded as needed to best respond to a specific request. WinGIG may retain for its internal administrative purposes and to help it improve its services any emails and other information sent to it. This information is not provided to any outside organisation. In order to best serve its users, WinGIG may send updates that contain important information about its sites and services. For example, new members are sent a welcoming message, and verification of password and username for passwordprotected sites. WinGIG may also communicate with a user to provide requested services and for account-related issues via email, phone, fax or regular mail.

4.  STATISTICAL INFORMATION

WinGIG computers automatically collect statistics about visits to its site. This information does not include personal information but only information about the visit. WinGIG may collect statistics such as how many people visit its site, users' IP addresses, which pages people visit, from which domains visitors come and which browsers people use. These statistics are used for aggregation purposes only and to help improve the performance of WinGIG services.

WinGIG uses "cookies," a piece of data stored on the user's hard drive containing information about the user. Cookies benefit the user by requiring login only once, thereby saving time while on the site. If users reject the cookies, they may be limited in the use of some areas of the site.

Information on each browser's handling of cookies can be found at their respective websites.

Demographic information supplied by a subscriber at registration may be combined with site usage data to provide general profiles, in aggregate non-personally identifiable form, about users and their preferences in the content of the site. This composite information may be used in advertising and may be shared with partners, current and prospective, to help them better understand WinGIG services.

5.  WITH WHOME INFORMATION IS SHARED?

Personally, identifiable information is not shared with other companies or organisations, apart from those with whom we have partnership agreements in providing our products or services, and which agree to use it only for that purpose and to keep the information secure and confidential. WinGIG will disclose information it maintains when required to do so by law, for example, in response to a court order or a subpoena or other legal obligation, in response to a law enforcement agency's request, or in special cases when WinGIG has reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) WinGIG rights or property.

WinGIG may share aggregate information, which is not personally identifiable, with others. This information may include usage and demographic data, but will not include personal information.

OUR GROUP COMPANIES

We may share your personal data with certain members of our group companies which also operate online job portals. Where they have access to your personal data, they will use it only for the purposes set out in this Privacy Policy. WinGIG will remain responsible for the management and security of jointly used Personal Information. Access to Personal Information within WinGIG and our group of companies, is restricted to those individuals who have a need to access the information for our business purposes.

RECRUITERS AND OTHER AGENTS

In the course of our business to help you search for and get a job, WinGIG may make Personal Information available to third parties such as recruiters and other intermediaries and agents and other business partners. The amount of information we share with recruiters will depend on the options you select when you create or update your account. If you choose to make your profile public, recruiters will be able to see and your Last Active date (this is the date you most recently updated your profile or CV, or searched or applied for jobs using the Services). Depending on your preferences, we may also share your application history (jobs you have applied for and when you applied for them). You can change the information recruiters can see about you at any time by updating your details and preferences in your profile.

OUR SERVICE PROVIDERS

This includes external third-party service providers, such as accountants, auditors, experts, lawyers and other outside professional advisors; IT systems, support and hosting service providers; printing, advertising, marketing and market research and analysis service providers; document and records management providers; technical engineers; data storage and cloud providers and similar third-party vendors and outsourced service providers that assist us in carrying out business activities.

6.  CORRECTIONS / UPDATING PERSONAL INFORMATION

If a user's personally identifiable information changes (such as phone number), or if a user no longer requires products or services, WinGIG provides a way to correct or update that user's personal data. The user should contact User Support for the applicable product or service.

7.  How can you manage or delete Personal Information?

When you access our website online, we store some information about you. This is anonymous and used for statistical purposes.

When you create an account and log-in to your “My Account” area, it is protected by your password and may only be accessed by you. You can manage the content and information in your Account at any time, by logging in to your “My Account”.

Your CV can be viewed by WinGIG, if you have consented to this within the profile section. This is the default setting. Further, when your profile is searchable your application activity (e.g. number of applications, job titles, locations & salaries) will be visible to WinGIG. Such visibility can also be provided through browser plugins or other software that we or our group companies offer if our customers visit certain social media websites about you. This is also the default setting.

Please note that WinGIG reserves the right to remove from our database, CVs which include any content that we consider to be illegal or offensive. We will respect the choices you make to limit sharing or visibility settings in your “My Account”.

You can de-activate or delete your account at any time, make your profile anonymous or choose to not make your profile searchable. To de-activate, please go to your “My Account”.

8.  SECURITY

The Website has security measures in place to protect the loss, misuse and alteration of the information under WinGIG’s control. WinGIG uses SSL encryption, access control policies, anti-virus programs and firewalls to protect information under our control. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. In addition, please note that emails, messages sent via your web browser, and other similar means of communication with other users are not encrypted. We strongly advise you not to communicate any confidential information through these means. Therefore, while we strive to protect your information, we cannot guarantee its security.

9.  ASSIGNMENT

If there is a change of ownership or control in WinGIG’s business (whether by merger, sale, or otherwise) or if there is an asset sale, the user information, including your personal information, could be disclosed as part of such a process and / or sold as part of that transaction and your personally identifying information potentially could be used by the purchaser. However, if that business materially changes this statement or the information-handling practices as described in this Privacy Policy, you will be notified by email and/or through a notice posted on the website, and you may opt-out of the use of your existing information in a new manner. This Privacy Policy inures to the benefit of any successors or assigns of WinGIG.

10.  DO NOT TRACT REQUESTS

We do not respond to the browser “Do Not Track” (DNT) signal if enabled by the user in their web browser. When we set or read cookies on non-WinGIG sites that have integrated our job search and display features, we do so in order to provide a personalized job search experience to users on those sites. We do not share any information about your use of WinGIG with those third-parties. When third-parties that we have integrated into WinGIG sites (as described in the WinGIG Cookie Policy) set or read their own third-party cookies, they may or may not respond to the DNT signal.

11.  THIRD-PARTY DISCLOUSRE

We don not sell, trade, or otherwise transfer to outside parties your Personally Identifiable information unless we provide users with advance notice. This does not include website hosting partners and other parties who assists us in operating our website, conducting our business, or serving our users, so long as those parties agree to keep this information confidential. We may also release information when it’s release is appropriate to comply with law, enforce our site policies, or protect ours or others’ rights, property or safety.

However, non-personally identifiable visitor information may be provided to their parties for marketing, advertising, or other uses.

12.  LINKS

WinGIG web sites contain links to other sites. WinGIG is not responsible for the privacy practices or content of such other sites. WinGIG encourages its users to be aware when they leave its site and to read the privacy statements of each web site they choose to visit.

13.  NOTIFICATION AND CHANGES

If WinGIG privacy policy is changed, those changes will be posted on this page so that users are aware of what information is collected, how it is used and under what circumstances, if any, it is disclosed. Users should check this policy frequently to keep abreast of any changes.
